Terms of Service

These terms are an agreement between you (the business that signs up, and anyone using the account for it) and Sales On Demand, based in Las Vegas, Nevada (“we”), for the Intent On Demand service. By creating an account or using the service you agree to them.
1. The service
Intent On Demand identifies people and companies that visit your website using a tracking pixel you install, lets you build audiences of people showing interest in topics, and lets you send that data to your own tools (spreadsheets, CRMs, ad platforms). Identity and intent data comes from third-party data providers. It is matched by probability and may be incomplete, out of date or wrong; we don't guarantee any match rate or result. Intent scores, company rollups and funnels are our own estimates, not facts.
2. Your account
- Give accurate sign-up details and keep your login secure. You're responsible for what happens under your account and your teammates' accounts.
- You must be at least 18 and using the service for a business.
- Only install the pixel on websites you own or are authorized to manage.
3. Your responsibilities for the data
You are responsible for how you use the data the service gives you. In particular, you agree to:
- Tell your website visitors, in your own privacy policy, that you use visitor identification and share data with service providers, and offer an opt-out where the law requires it (for example under the California Consumer Privacy Act and other state privacy laws).
- Follow telemarketing and texting laws, including the Telephone Consumer Protection Act and the National Do Not Call Registry. Numbers we mark as Do-Not-Call must not be called or texted for marketing without the consent the law requires.
- Follow email marketing laws, including CAN-SPAM, and honor unsubscribe requests.
- Not use the data to make decisions about anyone's eligibility for credit, insurance, employment or housing, or for any purpose covered by the Fair Credit Reporting Act.
- Not use the data to harass, stalk or discriminate against anyone, or resell it as a list.
- Add people who ask not to be contacted to your Do-not-contact list in Settings.
4. Acceptable use
Don't try to access other customers' data, break or overload the service, get around usage limits, reverse engineer it, or use it for anything illegal. We may suspend accounts that do.
5. Plans, billing and cancellation
- Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices and allowances are shown on the pricing page and in your Settings.
- Allowances (such as identified contacts per month) reset each billing cycle and don't roll over. Over your allowance, the service may stop revealing new people until the next cycle or an upgrade.
- Ad spend added to an ad wallet is used to buy media for your campaigns, with the markup shown before you add funds.
- You can cancel any time; the plan runs to the end of the period you've paid for. Payments aren't refundable except where the law requires.
- If a payment fails we may pause the account until it's fixed.
6. Your data
Data in your workspace belongs to you, and we use it only to provide the service, as described in our Privacy Policy. Before you cancel, you can ask us for a copy of your data; we may delete it after a reasonable period.
7. Third-party services
When you connect your own tools (for example a CRM or a Facebook ad account), your use of them is governed by their terms, and we send data there only because you asked us to.
8. Disclaimers and limit of liability
The service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We aren't liable for indirect, incidental or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
9. Indemnity
You agree to cover our reasonable costs if a claim against us arises from your use of the data or your breach of these terms.
10. Changes and governing law
We may update these terms; we'll post the new version here and, for material changes, tell account owners by email. Continuing to use the service means you accept them. These terms are governed by the laws of Nevada, and disputes go to the state or federal courts in Clark County, Nevada.
